Reasons To Report A Landlord

There are certain health and safety issues which could cause a tenant to file a complaint with the health department. These include:

  • Pests: A tenant may report a landlord if their apartment or rental property has shown signs of a mouse, rat, roach, bed bug, or other pest infestation.
  • Mold: Mold in the living space is dangerous as it can cause breathing problems or more severe reactions.
  • Lead: Lead paint is common in homes built before 1978. Lead hazards, such as chipping paint, can pose health risks, especially to young children.
  • Lack of Running Water, Electricity, or Heat: Tenants need to have access to certain vital services in their apartments. Tenants can report landlords if there is no running water in their apartment, if they do not have heat in the winter or if the landlord is responsible for paying the utility bills and there is no electricity at the property.

Landlord Legal Responsibilities For Tenant Exposure To Mold

With a few exceptions, landlord responsibilities regarding mold have not been clearly spelled out in building codes, ordinances, statutes, or regulations.

No federal law sets permissible exposure limits or building tolerance standards for mold in residential buildings, and only a few states , and a few cities , have taken steps toward establishing permissible mold standards or guidelines and regulations for mold in indoor air.

For information on mold rules and regulations in your state, check with your state department of environmental protection or your state department of public health.

To see whether your state is considering mold-related legislation that might affect residential rentals, you can search the National Conference of State Legislatures’ Environmental Health State Bill Tracking Database.     Gather Evidence And Report It

    Landlord Liability For Mold In Indiana

    There is currently no federal law covering a landlords responsibilities when it comes to mold. Also, although Indiana has enacted laws to regulate mold in schools and state agencies, the state has not yet specifically addressed a landlords duties or liability when it comes to mold prevention and remediation.

    However, tenants who believe they have been harmed by the presence of high concentrations of mold in their apartment can try to recover damages from their landlord in court to compensate them for their loss. If a judge or jury agrees that the landlord negligently created a mold problem or allowed one to continue at a property, the landlord could be on the hook for any harm.

    For example, after tenants at an Indianapolis apartment complex discovered a widespread mold problem in their building, a tenant reported it to county health officials. In addition to being present in apartments, the mold affected common areas including stairwells and the laundry room, according to a press report. County inspectors visited the complex several times and issued orders for the landlord to address the problems through mold remediation as well as plumbing and other building repairs. In the meantime, the tenants reportedly stopped paying rent until the mold issue was resolved.

    What Can You Do

    To prevent and get rid of mold:

    • Keep your house clean and dry.
    • Fix water problems such as roof leaks, wet basements, and leaking pipes or faucets.
    • Make sure your home is well ventilated and always use ventilation fans in bathrooms and kitchens.
    • If possible, keep humidity in your house below 50% by using an air conditioner or dehumidifier.
